最新消息！2021年Jessup赛题纲要发布，你怎么看？
北京时间2020年4月26日凌晨一点左右，Jessup国际法模拟法庭比赛主办方美国国际学生联合会（ILSA）发布了2021年Jessup赛题纲要。
2021年Jessup赛题纲要
本着蹭热度的风格，Jessup2021年的比赛与全球疫情爆发下国家义务与应对措施（Issue A）、国际法院的管辖权 （Issue B）、怪异科学家的政治庇护（Issue C）与航空器可疑爆炸的国家责任”（Issue D）等话题相关。
2018年，Jessup就紧跟“南海仲裁案”以及“中国海军捕获美国无人潜航器”等热点；2020年，Jessup则关注了苏丹前总统巴沙尔事件。

2021年Jessup议题A与B
Issue A涉及疫情下的国家义务与应对措施问题。这一话题（包括但不限于“中国责任论”）一直是当前国际法的热点问题。Issue B则是和Issue A相辅相成的问题，因为在不考虑实体问题成就与否的前提下，主张“中国责任论”最大的问题之一便是法院的管辖权问题。
在知名国际法博客EJIL:TALK!与Opinio Juris上，已有诸多文章讨论Issue A与Issue B。
例如，3月17日，英国剑桥大学Federica Paddeu博士发文讨论了新冠疫情与国家责任法下的抗辩（COVID-19 and Defences in the Law of State Responsibility, Part I & Part II）；3月31日，德国马克斯-普朗克研究所（马普所）Pedro Villarreal博士发文讨论新冠疫情背景中国家在《国际卫生条例》下的义务（COVID-19 Symposium: “Can They Really Do That?” States’ Obligations Under the International Health Regulations in Light of COVID-19, Part I & Part II）；4月2日，美国国际法律师Peter Tzeng更是直接发文讨论在国际法院起诉中国的可能性（Taking China to the International Court of Justice over COVID-19）。
针对外方渲染激烈的“中国责任论”，国内也有诸多学者发文进行了回应。
例如，4月12日，北京师范大学廖诗评副教授刊发《“国际追责”有效应对亟需“公私合作”》一文，讨论通过民间力量发声的可能性；4月15日，针对Peter Tzeng律师提出起诉中国的可能性，浙江工商大学宋杰教授刊发《通过<WHO章程>在ICJ起诉：没那么容易！》一文，从条约解释的角度出发主张国际法院没有管辖权；4月22日，武汉大学廖丽副教授刊发《从国际法角度驳斥英国智库向中国索赔谬论》一文，从政府行为合规的实体问题与法院管辖权等角度反驳“中国责任论”。
从上述各家的争论来看，2021年的Jessup比赛将会是非常独特且具挑战性的。
